PIME’s online presence provides marketing for it’s oustrource services (“PIMEOutsource” or “PIMEO”) as well as an educational website (www.MedicalLienRecovery.com) along with an educational member-based (“free” and “paid” memberships”) portal (PIMadeEasy.com, “PIMadeEasy” or “PersonalInjuryMadeEasy”) (collectively “PIMadeEasy”) to give visitors a general understanding of the personal injury and medical lien area and to provide education, resources tools and forms for potential use by individuals and businesses who choose to handle their own medical lien recovery services in the personal injury (non-worker’s compensation) area. Customer need not download or even license PIME software. PIME hosts third party software as a backend service for customers to review much of the Content, Applications and Services. The Site includes general information on commonly encountered issues in the medical lien area. Customers can use the PIME self-help educational portal and services to do-it-themselves; or, can retain PIME as an outsource third party service to handle medical lien recovery issues and negotiations (in states where PIME offers such services). At no time does PIME review any aspect for legal sufficiency, draw legal conclusions, provide legal advice, opinions or recommendations about your legal rights, defenses, options, remedies, selection of forms, services, processes, or strategies, or apply the law to the facts of your particular situation. PIME strives to keep its Content, Applications & Services, including forms, tools, resources and “how to’s”, accurate, current and up-to-date. The laws and health care regulations are different from jurisdiction to jurisdiction, and federally, and may be subject to interpretation by different courts and administrative bodies. Good business practices and the law and health care regulations are a personal matter, and no general information or tool or “how to” like the kind PIME provides can fit every circumstance or even your circumstance exactly. Furthermore, the legal information contained on the Site, Applications or in the Services is not legal advice and is not guaranteed to be correct, complete or up-to-date. Therefore, if you need legal, health care, or business advice for your specific problem, or if your specific problem is too complex to be addressed by PIME’s Content, Application & Services, including the forms, “how to’s” and tools, you should consult a licensed attorney, licensed health care or fee expert, or business consultant in your area immediately, depending upon your unique circumstances.

Summary:
Most customer concerns can be resolved quickly and to the customer’s satisfaction by calling our Customer & Member Care Center at (310) 651-6391. In the unlikely event that the PIME Customer Care Center is unable to resolve your complaint to your satisfaction (or if PIME has not been able to resolve a dispute it has with you after attempting to do so informally), the parties each agree to resolve those disputes through binding arbitration or in small claims court rather than in a court of general jurisdiction. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than a court does, and is subject to very limited review by courts. Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted. While in some instances, upfront costs to file an arbitration claim may exceed similar costs to bring a case in court, for any non-frivolous claim that does not exceed certain limited jurisdictional amounts, PIME will pay all costs of the arbitration. Moreover, in arbitration you may recover attorney’s fees from PIME to the same extent or more as you would in court. The arbitrator shall apply the same limitations period that would apply in court.
Under certain circumstances (as explained below), PIME will pay you more than the amount of the arbitrator’s award and will pay your attorney (if any) his or her reasonable attorney’s fees if the arbitrator awards you an amount greater than what PIME offered you to settle the dispute.
You may speak with independent counsel before using this Site or completing any purchase.
Arbitration Agreement:
(a) PIME and you agree to arbitrate all disputes and claims between us before a single arbitrator located in Orange County, State of California. You agree to personal jurisdiction within the County of Orange, State of California. All arbitrated disputes shall be governed by California law excepting choice of law principles. The types of disputes and claims we agree to arbitrate are intended to be broadly interpreted. It applies, without limitation, to:
For the purposes of this Arbitration Agreement, references to “PIME” “you,” and “parties” include our respective subsidiaries, affiliates, agents, employees, employers, business partners, shareholders, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or products under these Terms or any prior agreements between us. Beneficiaries include, but are not limited to, those named in an estate planning document.
Notwithstanding the foregoing, either party may bring an individual action in small claims court located in Orange County, State of California. This arbitration agreement does not preclude your bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf. You agree that, by entering into these Terms, you and PIME are each waiving the right to a trial by jury or to participate in a class action. These Terms evidence a transaction or website use in interstate commerce, and thus the Federal Arbitration Act (“FAA”) governs the interpretation and enforcement of this provision. This arbitration provision will survive termination of these Terms.
(b) A party who intends to seek arbitration must first send, by U.S. certified mail, a written Notice of Dispute (“Notice”) to the other party. A Notice to PIME should be addressed to: Notice of Dispute, General Counsel, PI Made Easy, LLC 751 South Weir Canyon Road, Suite 157, Anaheim, CA 92808 (the “Notice Address”). The Notice must (a) describe the nature and basis of the claim or dispute and (b) set forth the specific relief sought (“Demand”). If PIME and you do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or PIME may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by PIME or you shall not be disclosed to the arbitrator.
You may download or copy a form to initiate arbitration from the American Arbitration Association (“the AAA”) website at https://www.adr.org.
(c) The arbitration procedure will be governed by the Consumer Arbitration Rules (the “AAA Rules”) of the American Arbitration Association, as modified by these Terms, for all claims under $75,000, and the applicable rules as determined by the AAA for all claims of or above $75,000, and will be administered by the AAA. The AAA Rules are available online at www.adr.org or by calling the AAA at 1-800-778-7879. (You may obtain information about the arbitration process directed to non-lawyers, including information about providing notice to PIME as specified herein. The arbitrator is bound by these Terms. All issues are for the arbitrator to decide, except that issues relating to the scope, enforceability, and interpretation of the arbitration provision and the scope, enforceability, and interpretation of paragraph (f) are for the court to decide. Unless PIME and you agree otherwise, any arbitration hearings will take place in Orange County, State of California. If your claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, by a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If you choose to proceed either in person or by telephone, we may choose to respond only by telephone or submission. If your claim exceeds $10,000, the AAA Rules will determine whether you have a right to a hearing. The parties agree that in any arbitration of a dispute or claim, neither party will rely for preclusive effect on any award or finding of fact or conclusion of law made in any other arbitration of any dispute or claim to which PIME was a party. The parties shall pay equally all AAA arbitrator fees for any arbitration initiated in accordance with the notice requirements above. If, however, the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), you agree to reimburse PIME for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. In addition, if you initiate an arbitration in which you seek relief valued at more than $75,000 (excluding attorney’s fees and expenses), the payment of these fees will be governed by the AAA rules.
(d) The arbitrator may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. YOU AND PIME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITIES AND NOT AS PLAINTIFFS OR CLASS MEMBERS IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING OR IN THE CAPACITY OF A PRIVATE ATTORNEY GENERAL. Further, unless both you and PIME agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator may award any relief that a court could award that is individualized to the claimant and would not affect other customers. Neither you nor we may seek non-individualized relief that would affect other customers. If a court decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and may be brought in court.
(e) If the amount in dispute exceeds $75,000 or either party seeks any form of injunctive relief, either party may appeal the award to a three-arbitrator panel administered by AAA by a written notice of appeal within thirty (30) days from the date of entry of the written arbitration award. An award of injunctive relief shall be stayed during any such appeal. The members of the three-arbitrator panel will be selected according to AAA rules. The three-arbitrator panel will issue its decision within one hundred and twenty (120) days of the date of the appealing party’s notice of appeal. The decision of the three-arbitrator panel shall be final and binding, subject to any right of judicial review that exists under the FAA.
(f) Notwithstanding any provision in the applicable Terms to the contrary, we agree that if we make any future change to this arbitration provision (other than a change to any notice address, website link or telephone number provided herein), that change will not apply to any dispute of which we had written notice on the effective date of the change. Moreover, if we seek to terminate this arbitration provision, any such termination will not be effective until at least thirty (30) days after written notice of such termination is provided to you, and shall not be effective as to disputes which arose prior to the date of termination.

The Privacy Policy covers PIME’s treatment of the Personally Identifiable Information we collect about you. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. This Privacy Policy is incorporated into our Terms of Use and therefore governs your use of the Online Services. By using PIME’s Online Services, you accept the terms of this Privacy Policy. If you have questions or concerns about the Privacy Policy, please contact Customer & Member Care Team at customercare@pimadeeasy.com.
This privacy policy discloses the privacy practices for this site – what information we gather, how we use it and how to correct or change it. This privacy policy only addresses our activities from our servers.
PLEASE READ THE TERMS OF USE AND OUR PRIVACY POLICY CAREFULLY BEFORE USING THIS SITE.
What Information Do We Collect About Our Customers?
Traffic Data. PIME may collect a variety of visitor data such as IP addresses, browser settings, internet service provider (ISP) information, referring/exit pages, operating systems, date/time stamps, and clickstream data (collectively “Visitor Data”). The PIME internal servers and software automatically recognize Visitor Data. PIME’s website (the “Site”) may use Visitor Data to compile traffic data about the types of visitors who use the Site at specific intervals (collectively “Traffic Data”).
We may use Traffic Data to analyze Site traffic, but this information is not examined for Personally Identifiable Information. We may also use Traffic Data to diagnose problems with our server, administer our Site, or display content according to your preferences. Visitor Data and Traffic Data may also be shared with business partners, affiliates, or advertisers on an aggregated and anonymous basis.
Cookies and Similar Technologies. PIME and its partners may use the standard cookie feature of major browser applications and third-party providers, including Google Analytics features (Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration and Google Analytics Demographics and Interest Reporting), or employ internally developed cookies and tracking codes, that allow PIME to store a small piece of data on a visitor’s computer, or any other device a visitor uses to access Online Services, about his or her visit to the Site or use of other plug-ins exchanging information with PIME (“Applications”). (The Site and Applications are sometimes collectively referred to as “Online Services” for simplicity.) Similar technologies, such as java scripts or etags, are also used to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory. If you reject cookies, you may still use our site, but your ability to use some areas of our site, such order forms, will be limited.
Web Beacons . We may at some point employ a software technology called clear gifs (a.k.a. web beacons), that help us track referrals from our partners and affiliates and better manage content on our site. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We would not tie the information gathered by clear gifs to our customers’ Personally Identifiable Information.
3rd Party Tracking. The use of tracking technologies by our service providers, technology partners or other Third Party Services and/r 3rd party assets (such as social media links) on the site is not covered by our Privacy Policy. These 3rd parties may use cookies, clear gifs, images, and scripts to help them better manage their content on our site. We do not have access or control over these technologies. We do not tie the information gathered to our Customers’ or Users’ Personally Identifiable Information.
Personal Information. PIME requires each customer to provide us with personal information (collectively “Personally Identifiable Information”) to access and use PIME Subscription Services which are in our back end, protected by username and password. Personally Identifiable Information is captured when a visitor accesses Online Services, or speaks on the phone with PIME and willingly discloses that information. This disclosure may occur when a visitor registers with our Online Service, engages in transactions, contacts customer service, or participates in contests, promotions, surveys, forums, content submissions, requests for suggestions, or other aspects of services offered by PIME.
Personally Identifiable Information includes but is not limited to: (i) “Contact Data” (such as your name, address, city, state, zip code, phone number, and email address); (ii) “Financial Data” (such as your credit card number, expiration date, and verification code or bank account information); (iii) “Demographic Data” (such as your zip code and sex); and (iv) other “Legal Data” (such as your social security number, EIN number, mortgage information, automobile information, marital information, trade secrets, inventions, and idea submissions and other sensitive information necessary to generate legal documents if those are asked for).
We may also receive information about our customers or potential customers from other sources. In some instances we may combine this data with information we already have or that we later receive from our customers. This helps us to update, expand and analyze our records and to provide better service to customers. We will only use this information for the specific reasons that it was provided to us, which may include marketing related uses. Examples of the types of Personally Identifiable Information that we may receive from third parties include Contact Data and Legal Data.
We may collect the information of 3rd party individuals as necessary, such as to ask our customers to register authorized contacts to access their PIME account. PIME uses this information for the sole purpose of administering its services for our customers, and does not use such information for any other reason.
If you believe that one of your contacts has provided us with your personal information and you would like to request that it be removed from our database, please contact us at Customercare@pimadeeasy.com.
Certain personal information becomes public record when documents are filed with the federal or state government, or with a court. For example, if a medical lien is recorded with a particular Secretary of State’s office. The PIME Privacy Policy does not cover these or similar third-party actions.

If you do not wish to receive email from PIME , you may unsubscribe from our mailing list by using the “Unsubscribe” link on any of the emails we send.
How Do We Use the Information We Collect and Do We Share the Information We Receive?
We use information we collect to communicate with you, process your orders, facilitate your transactions with our third-party marketing partners, for research into how to improve our service and product offerings, and to inform you of offers and discounts. For example, you may receive a welcome email that confirms your username and password, and later receive communications responding to your inquiries, providing services you request, and managing your account. We occasionally send service-related announcements, for example, to alert you if we need to temporarily suspend the Site for maintenance.
Opting Out. We send promotional emails and newsletters from time to time to users who have registered on the site and to those who have opted in to receive such emails. Generally, you may not opt-out of service-related or transactional communications, which are not promotional. If you do not wish to receive service-related communications, you may terminate your account by contacting Customer Care at Customercare@pimadeeasy.com. However, you can opt-out of promotional communications by using the “Unsubscribe” link and following the unsubscribe instructions in any electronic communication or by emailing us at Customercare@pimadeeasy.com.
You may choose not to provide PIME with Personally Identifiable Information or you may turn off cookies in your browser by changing its settings. If you make these decisions, you may continue to use the Online Services and browse its pages. However, PIME cannot process orders without Personally Identifiable Information.
Surveys, Sweepstakes, and Contests . We may provide you the opportunity to participate in surveys on our site, to measure customer satisfaction. If you participate, we may request certain personally identifiable information from you. Participation in these surveys, sweepstakes, or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes name, email address, and mailing address.
We use this information to notify contest winners and award prizes, to monitor site traffic or personalize the site, and/or to send participants an email newsletter.
We may use a third party service provider to conduct these surveys or contests; that company will be prohibited from using our users’ personal information for any other purpose. We will not share the personal information you provide through a contest or survey with other third parties unless we give you prior notice and choice.
We share customer information with third parties only as follows:
Order Processing. PIME, sometimes with the assistance of a third part, may use your Personally Identifiable Information to process your payment through merchant account services, and to generate the products and services you order. Your Contact Data may be used to follow up with you on transactions you initiate, respond to inquiries, inform you of changes to Online Services, and send you additional information about PIME and its products and services.
Third Party Marketing. Unless specifically authorized by you, we do not provide Personally Identifiable Information to third parties for their marketing purposes. If you express interest in a third party offer, we may provide your Personally Identifiable Information to that third party solely in connection with the offer you have selected. If you later decide to opt-out from allowing PIME to share your Personally Identifiable Information with third parties for their marketing purposes, you may do so by contacting Customer Care at Customercare@pimadeeasy.com. To the extent that PIME has already shared your Personally Identifiable Information with third parties for their marketing purposes prior to your decision to opt-out, you may opt out from future marketing by contacting the Third Parties directly but realize we have no control over the Third Parties at that point.
Required by Law. We may also disclose your personal information: as required by law, such as in response to a subpoena, a lawful request by a public authority, including to meet national security or law enforcement requirements, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legal request.
Visitor Demographics. Contact Data and Traffic Data are used to gather general statistics about our customers and visitors. We may use Demographic Data to generate collective information about our users, but not in a way that identifies any user specifically. For example, we may inform third parties about the number of registered users and unique visitors, and the pages most frequently browsed.
Professional-Assisted Products & Services. As a convenience to you and your attorney, we may share your Personally Identifiable Information, information about your order, and your order history with Professionals who service our professional-assisted products or services. We will notify you prior to sharing this information and, where the information is not necessary to complete your order, give you the opportunity to opt-out.
Service Providers. We may share your Personally Identifiable Information with companies that provide support services to us (such as a printer or email service provider), help us market our products and services, or for training purposes. These companies may need information about you in order to perform their functions. These companies are not authorized to use the information we share with them for any other purpose.

In the event of a PIME bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used. If such an event occurs, your Personally Identifiable Information may be treated like any other PIME asset and sold, transferred, or shared with third parties, or used in ways not contemplated or permitted under this Privacy Policy. In this case, you will be notified via email and/or a prominent notice on our site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
